New Guidelines on Imposing Fines for Competition Law Violations

08.04.2024 | Polish competition authority

The President of the Polish Competition Authority has issued new guidelines on imposing fines for anticompetitive practices, including factors affecting the amount of fines.

The President of the Polish Office of Competition and Consumer Protection (UOKiK) has released new explanations on the imposition of fines for practices restricting competition, aligning with the ECN+ Directive. The guidelines clarify factors influencing fine amounts, such as the duration of the infringement, type of practice, and market effects. They also address mitigating circumstances like cooperation with UOKiK and aggravating factors such as leading a cartel. The President may adjust fines if deemed inadequate, providing additional justification.
