Polish Competition Authority Imposes Fines for Payment Delays
The President of the Polish competition authority has imposed over 3.3 million PLN in fines on 11 companies for causing payment delays, alongside a separate fine for failure to provide information.

The President of the Polish competition authority (UOKiK) has taken significant action against companies causing payment delays, imposing fines totaling over 3.3 million PLN on 11 businesses. Additionally, a fine of over 450,000 PLN was levied against a company for not providing requested information.
Since the beginning of the year, UOKiK has issued 128 soft interventions to businesses regarding payment delays. The authority acts as both the first and second instance in these matters, reviewing appeals from fined companies. In recent cases, nearly 320,000 invoices from over 9,000 suppliers were analyzed.
The companies fined operate in various sectors, including automotive, packaging, wind energy, construction, machinery, cosmetics, food, and pharmaceuticals. Notable fines include WISS Samochody Specjalne (614,389 PLN) and Medi&More (1,094,956.58 PLN). Six of the eleven fined companies accepted the penalties, resulting in a 20% reduction.
When determining fines, UOKiK considered not only the value of overdue payments and the duration of delays but also mitigating and aggravating circumstances specific to each case. In some instances, companies demonstrated efforts to minimize payment delays, which influenced the reduction of their penalties.
UOKiK emphasizes the importance of active cooperation from companies during proceedings, which can lead to lower fines. In two cases, companies proved they were victims of payment delays themselves, resulting in reduced penalties.
Furthermore, UOKiK has imposed a fine of 456,303.71 PLN on Neptun for failing to respond timely to requests during investigations, highlighting the obligation of companies to provide necessary information as per the law.
Soft interventions are also employed to inform companies about identified irregularities and potential consequences of continued practices leading to payment delays. UOKiK encourages businesses to improve their payment discipline without initiating formal proceedings.
Individuals suspecting a company of excessive payment delays can report it to UOKiK, provided they include specific details and supporting documents.
