CMA Initiates Investigations into Online Pricing Practices

The UK Competition and Markets Authority (CMA) has launched investigations into several businesses for potential breaches of consumer law regarding online pricing practices, marking the first use of its new consumer protection powers.

The UK Competition and Markets Authority (CMA) has announced a significant initiative aimed at addressing online pricing practices, including drip pricing and pressure selling, under the new Digital Markets, Competition and Consumers Act 2024 (DMCCA). This initiative is designed to enhance consumer confidence and ensure fair competition among businesses.

As part of this initiative, the CMA has opened investigations into eight businesses suspected of violating consumer laws related to additional fees and misleading sales tactics. These investigations are the first enforcement actions taken under the CMA's new powers, which allow it to determine breaches of consumer law without court intervention.

The CMA's review, which assessed over 400 businesses across 19 sectors, identified compliance concerns in 14 sectors, particularly regarding the use of misleading countdown timers and additional charges that are not disclosed upfront. The CMA aims to protect consumers by ensuring they receive accurate pricing information.

In addition to the investigations, the CMA is sending advisory letters to 100 businesses across various sectors, urging them to review their pricing practices to comply with the law. The sectors targeted include driving schools, homeware retailers, and live event ticketing, among others.

The CMA has also published new guidance to assist businesses in adhering to pricing transparency laws. This guidance emphasizes the importance of including mandatory charges in advertised prices and avoiding misleading pricing practices.
