Investigation into Anticompetitive Practices in Private Healthcare Sector

The Spanish competition authority, CNMC, is investigating potential anticompetitive practices in the private healthcare and consulting sectors, including possible collusion and abuse of dominance.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has launched an investigation into possible anticompetitive practices within the private healthcare and healthcare consulting sectors. This inquiry focuses on potential agreements or coordinated practices among companies operating in these areas, as well as possible abuse of dominant market positions by certain firms.

Between November 18 and 21, 2025, the CNMC conducted inspections at the premises of several companies, in collaboration with the regional competition authority of the area where these companies are located. These inspections are a preliminary step towards potentially initiating a sanctioning procedure, although they do not prejudge the outcome of the investigation or the culpability of the inspected companies.

Violations of competition law, particularly agreements between competitors, are considered very serious infractions under the Ley de Defensa de la Competencia (LDC). Such violations can result in fines of up to 10% of the total turnover of the infringing companies from the previous financial year.
