CMA Launches New Consumer Protection Regime to Enhance Trust and Compliance

07.04.2025 | UK competition authority

The UK's Competition and Markets Authority (CMA) has implemented a new consumer protection regime aimed at improving corporate practices and boosting consumer confidence, as outlined in the Digital Markets, Competition and Consumers Act 2024.

The Competition and Markets Authority (CMA) has introduced a landmark consumer protection regime under the Digital Markets, Competition and Consumers Act 2024 (DMCCA), which empowers the CMA to directly address breaches of consumer protection laws without resorting to court litigation.

This new framework is designed to enhance consumer trust and safeguard interests, thereby promoting economic growth. The CMA aims to create a level playing field for businesses that adhere to the law, ensuring that they can compete fairly without being undercut by those engaging in poor corporate practices.

The CMA has committed to a proportionate approach, providing guidance to businesses on compliance while minimizing burdens. The 'Approach to Consumer Protection' document outlines priority enforcement areas, the CMA's strategic goals, and what stakeholders can expect from the authority.

Key areas of focus include aggressive sales tactics, hidden fees, and unfair contract terms. The CMA has also banned practices such as fake reviews and drip pricing, which mislead consumers during the purchasing process. The authority plans to consult further on newer aspects of the law to ensure clarity for businesses.

In the first year, the CMA will target particularly harmful behaviors, including misleading information and unfair contract terms. The authority has outlined its commitment to improving its operational framework through the '4Ps'—proportionality, predictability, process, and pace—to support business growth while fulfilling its mandate to protect consumers.

Next steps for the CMA include opening enforcement cases under the new regime, engaging with stakeholders to identify areas needing consumer law advice, and providing avenues for businesses to report potential law infringements by competitors.
