On October 8, 2026, the Court of Justice of the European Union dismissed the appeal from Brasserie Nationale and Munhowen SA, ordering them to bear their own costs as well as those incurred by the European Commission and Anheuser-Busch InBev.

The appeal sought to annul the ruling of the General Court of the European Union from July 2, 2025, which had rejected an earlier challenge by Brasserie Nationale and Munhowen SA against the European Commission's decision from March 14, 2024.

The European Commission had accepted a referral request from the Luxembourg competition authority to review the acquisition of Boissons Heintz by Brasserie Nationale, which raised significant competition concerns in the Luxembourg market.

On March 15, 2024, the European Commission decided to examine the acquisition, requiring Brasserie Nationale to notify the operation. The Commission later conditionally authorized the acquisition, provided that Brasserie Nationale divests a majority of Boissons Heintz's Horeca activities.

Brasserie Nationale and Munhowen SA filed their appeal on August 29, 2025, challenging the General Court's decision to uphold the Commission's examination of the merger.
