The Croatian Competition Agency (CCA) has opened an infringement proceeding against Trgovina Krk d.d., a retailer, under the Act on prohibition of unfair trading practices in the business-to-business food supply chain (UTPs Act). This action aims to assess whether Trgovina Krk has exploited its strong bargaining power to impose unfair conditions on its suppliers of agricultural and food products.
The decision to initiate this proceeding follows a preliminary investigation into the agri and food market, which included an examination of compliance with the UTPs Act by various retail sector buyers, including Trgovina Krk. The CCA emphasizes that the initiation of an administrative procedure does not imply that unfair trading practices have occurred.
The CCA will conduct a thorough investigation into the nature of the business relationships between Trgovina Krk and its suppliers. The agency will evaluate all relevant facts and concrete evidence before making a final decision regarding the case.
