French Competition Authority Fines TotalEnergies and Others €187.5 Million for Anticompetitive Practices in Corsica

The French competition authority has imposed a €187.5 million fine on TotalEnergies Marketing France and two Rubis group companies for engaging in anticompetitive agreements in the fuel distribution sector in Corsica.

The Autorité de la concurrence in France has sanctioned TotalEnergies Marketing France, Rubis group companies, and EG Retail with a total fine of €187.5 million for anticompetitive practices in the road fuel distribution sector in Corsica. This decision follows an investigation initiated in December 2021, which was prompted by a complaint from Ferrandi in September 2022.

The investigation revealed that the companies involved had entered into an agreement that reserved the right of passage within Corsican fuel depots exclusively for their benefit, effectively foreclosing non-shareholder competitors. This practice forced competitors to purchase fuel under unfavorable conditions, leading to increased costs and higher prices for consumers.

The Autorité highlighted the concentrated nature of the fuel distribution market in Corsica, where only three operators dominate. The lack of competitive pressure from other sectors, such as food retail, exacerbated the situation, negatively impacting household budgets in Corsica.

The total fines imposed include €115.8 million for TotalEnergies Marketing France, €64.67 million for Rubis, and €7 million for EG Retail. The Autorité has also mandated the companies to publish a summary of the decision in the local newspaper, Corse Matin.
