Austrian Construction Cartel: Leithäusl Fined 1.25 Million Euros

The Austrian Competition Authority requested a fine of 1.25 million euros against Leithäusl for engaging in cartel activities such as price-fixing, market allocation, and information exchange with competitors in public and private construction tenders from July 2002 to October 2017.

Leithäusl cooperated with the competition authority outside the leniency program, providing comprehensive information and admitting to the violations, leading to a reduced fine being proposed.

The cartel uncovered in the construction sector primarily affected road construction projects across Austria, involving agreements among companies to secure contracts, maintain market shares, and ensure capacity utilization through anti-competitive practices.
