The Competition and Markets Authority (CMA) has released its response to the Department for Business and Trade's (DBT) call for evidence concerning the opt-out collective actions regime in the UK.

In its response, the CMA underscores the necessity for effective collaboration between public and private enforcement mechanisms to enhance the overall efficacy of the UK competition law framework.

The CMA outlines its perspectives on several key areas, including the approach to concurrent private and public enforcement actions, the conditions under which businesses cooperating with investigations should be shielded from private enforcement actions, and the potential benefits of empowering the CMA to mandate redress in cases under the Competition Act 1998 (CA98), which could potentially lessen the reliance on private enforcement actions.
