The Comisión Nacional de los Mercados y la Competencia (CNMC) has concluded a sanctioning case against the Council General of Dentists for not adhering to commitments made in 2021. This case stemmed from an investigation initiated in 2019 due to complaints from two dental clinics regarding potentially anticompetitive advertising practices.
In 2021, the CNMC resolved the case through a conventional termination, where the Council General agreed to certain commitments. However, they failed to submit a required report on their communication activities and did not provide a certificate confirming the publication of the CNMC's resolution on their website. This failure constitutes a serious violation of the Competition Defense Law.
Recognizing their responsibility, the Council General of Dentists opted for a reduction in the fine under Article 85.3 of Law 39/2015, resulting in a final payment of €25,136, reduced from the original €41,893. With this payment, the CNMC has officially closed the sanctioning case.
