On April 10, 2025, the Greek Competition Authority (E.A.) carried out an unexpected on-site inspection at a company operating in the transport sector. This action is part of an investigation into possible abuse of a dominant position under Greek law 3959/2011 and Article 102 of the Treaty on the Functioning of the European Union (TFEU).
The surprise inspection follows a complaint aimed at identifying anti-competitive practices as per the provisions of law 3959/2011. It is important to note that the inspections are conducted at businesses from which information regarding anti-competitive practices can be gathered, and do not imply that the companies are engaged in anti-competitive behavior or predict the outcome of the investigation.
The E.A., as the guardian of the proper functioning of the free market, is responsible for enforcing competition rules based on law 3959/2011 and Articles 101/102 of the TFEU. Articles 1 of law 3959/2011 and 101 TFEU prohibit agreements between businesses that restrict competition.
Additionally, Article 1A of law 3959/2011 forbids unilateral practices that invite prohibited collusion and the announcement of future pricing intentions to competitors. Articles 2 of law 3959/2011 and 102 TFEU prohibit abusive behavior by companies with a dominant market position.
The E.A. emphasizes that it will prioritize intervention where necessary and will examine any relevant cases that come to its attention through complaints, leniency applications, or anonymous tips via a secure digital environment. The authority will impose strict administrative penalties on companies that engage in anti-competitive practices under the provisions of law 3959/2011 and Articles 101/102 TFEU.
