ACCC Takes Legal Action Against Microsoft for Misleading Subscription Practices

The Australian Competition and Consumer Commission has initiated court proceedings against Microsoft for allegedly misleading millions of customers regarding Microsoft 365 subscription options and price increases.

The Australian Competition and Consumer Commission (ACCC) has filed a lawsuit against Microsoft Australia and its parent company, Microsoft Corporation, claiming that they misled approximately 2.7 million Australian customers about their Microsoft 365 subscription options. The allegations stem from communications regarding the integration of the AI assistant, Copilot, into Microsoft 365 plans, which purportedly forced subscribers to accept higher prices or cancel their subscriptions.

According to the ACCC, since October 31, 2024, Microsoft informed subscribers of the Microsoft 365 Personal and Family plans that they must either accept the new Copilot integration at a higher price or cancel their subscription. However, the ACCC argues that Microsoft failed to disclose a third option: the Classic plans, which allowed subscribers to retain their existing features without Copilot at the previous lower price.

The ACCC claims that Microsoft's communications were misleading as they did not mention the availability of the Classic plans until after subscribers initiated the cancellation process. This omission allegedly aimed to increase the number of consumers on the more expensive Copilot-integrated plans. The ACCC's investigation was prompted by numerous consumer reports and discussions in online forums.

The ACCC is seeking various orders, including penalties, injunctions, and consumer redress for those affected by the alleged misleading conduct. The case highlights the importance of accurate communication regarding subscription services and pricing, particularly in the digital economy.
