The Spanish competition authority, CNMC, has sanctioned Viacom International Media Networks España, S.L.U. for broadcasting content on Comedy Central with an incorrect age rating. The incident occurred on October 8, 2024, when a program was labeled as suitable for all audiences ('TP'), despite its official rating being 'not recommended for children under 12 years old' as per ICAA guidelines.
This misclassification breached the General Audiovisual Communication Law, which mandates that service providers must provide clear and sufficient information regarding content that may be harmful to minors. The CNMC emphasized the importance of age ratings as a tool for parents and guardians to assess the appropriateness of content for children.
During the broadcast, the displayed rating did not match the official classification, potentially misleading viewers about the content's suitability. The law requires audiovisual service providers to accurately inform about potentially harmful content through age ratings, visual symbols, and warnings.
Viacom acknowledged the error, attributing it to an isolated human mistake, and stated that it has revised its procedures to prevent future occurrences. The CNMC confirmed a minor infringement of the General Audiovisual Communication Law and noted that Viacom accepted responsibility, leading to a reduced fine. Initially set at €12,500, the final penalty after a 40% reduction for early payment was €7,500.
