ACM Enforces Registration Compliance Among Energy Traders

The Dutch competition authority, ACM, has successfully prompted dozens of energy traders to register for compliance with the Direct Electronic Access requirement, enhancing market integrity.

The Netherlands Authority for Consumers and Markets (ACM) has reported that numerous energy traders utilizing Direct Electronic Access (DEA) have now registered as required. This registration is crucial for ensuring integrity and transparency in the wholesale energy markets, as well as facilitating the enforcement of market abuse regulations.

ACM has been actively reminding businesses about the registration requirement, which is mandated by the European REMIT regulation. This regulation aims to promote transparency in the wholesale energy markets, particularly in the Netherlands, which hosts the largest natural gas market in Europe. Over 950 market participants have registered with ACM, and the authority is prepared to take enforcement action against any that fail to comply.

ACM emphasizes the role of DEA providers as gatekeepers who can monitor the trading activities of their clients. These providers are urged to ensure their customers are aware of the registration requirement. If ACM identifies any DEA providers granting access to unregistered businesses, it will confront them and take necessary enforcement actions.

In addition to registration, market participants must adhere to other REMIT regulations, including mandatory trading data reporting. ACM is also preparing for upcoming changes to the REMIT Implementing Regulation by the European Commission, which will introduce new compliance rules.

ACM collaborates with various regulatory bodies to prevent insider trading and market manipulation, receiving reports on potential illegal activities. The authority remains vigilant in investigating these reports and ensuring compliance among market participants.
