FTC Invites Public Input on Rental Housing Fee Practices

The Federal Trade Commission is seeking public comments on proposed rulemaking to tackle unfair or deceptive fee practices in rental housing, aiming to enhance transparency and competition.

The Federal Trade Commission (FTC) has announced its intention to seek public comments on a proposed rulemaking aimed at addressing potentially unfair or deceptive fee practices in the rental housing sector. This initiative is part of the FTC's broader effort to ensure transparency in rental pricing and protect consumers from misleading practices.

Christopher Mufarrige, Director of the FTC’s Bureau of Consumer Protection, emphasized that unclear rental pricing practices can undermine competition and harm consumers. The lack of transparency in total rent can lead to increased search costs for consumers and may result in them taking on more rent than they can afford.

The Advance Notice of Proposed Rulemaking (ANPRM) invites comments on various aspects of rental housing fees, including the clarity of total rent disclosures, the nature and purpose of fees, application fees, security deposits, billing issues, and consumer choice. The FTC is particularly interested in understanding whether a rule is necessary to prevent these unfair practices.

In recent years, the FTC has taken action against major rental housing providers for unfair practices. For instance, Invitation Homes settled for $48 million over allegations of excluding mandatory fees from advertised rent, while Greystar Real Estate Partners was ordered to change its fee disclosure practices and pay $23 million in consumer redress.

The proposed rulemaking aims to address hidden fees that inflate rental costs and to deter such practices by allowing the FTC to impose civil penalties on violators. The public will have 30 days to submit comments electronically or in writing once the ANPRM is published in the Federal Register.
