DOJ Antitrust Division Approves DOE's Updated Voluntary Agreement for Nuclear Energy

The DOJ's Antitrust Division has approved the DOE's updated Voluntary Agreement under the Defense Production Act, aimed at enhancing the domestic nuclear energy supply chain.

The U.S. Department of Justice’s Antitrust Division has granted approval for the Department of Energy's Defense Production Act Consortium's updated Voluntary Agreement and related Plans of Action. This decision follows consultations with the Federal Trade Commission and is aimed at bolstering the domestic nuclear energy sector.

Acting Assistant Attorney General Omeed A. Assefi emphasized the importance of the Defense Production Act in addressing national defense and preparedness issues. He commended the domestic nuclear energy companies involved in the Consortium for their commitment to strengthening the nuclear industrial base while adhering to antitrust laws.

Assistant Secretary of Nuclear Energy Ted Garrish highlighted the critical timing for nuclear energy growth in the U.S. and expressed optimism about achieving a robust American-made supply of nuclear fuel through the Consortium's efforts.

The agreements established under the DPA aim to enhance domestic fuel availability, ensure reliable power access, and reduce dependence on foreign enriched uranium and critical materials. They facilitate collaboration among U.S. nuclear energy companies to maintain a comprehensive nuclear fuel supply chain, covering all aspects from mining to recycling.

Under DPA Section 708, the industry is authorized to enter agreements necessary for national defense, with a limited antitrust defense available for actions taken to implement these agreements. The DOJ will continue to work with the FTC and DOE to monitor the Consortium's implementation of the approved agreements.
