Epaka, a freight company based in Łuków, was found to have applied multiple unfair clauses in consumer contracts from March 2, 2018, to August 3, 2023. The President of UOKiK identified nine abusive clauses, including misleading information, additional obligations on consumers, and hindering the complaint process. Epaka was fined a total of 5,850,376 PLN. The company required customers to accept the terms of selected carriers without providing access to these documents, imposed unjustified obligations on recipients of damaged packages, disclaimed responsibility for carrier legality, shortened complaint deadlines while allowing exceeding statutory response times, and reserved the right to change terms without specifying the basis or scope of such actions. The decision is appealable.
