ACCC Seeks Input on Superfast Broadband Access Regulations

The Australian Competition and Consumer Commission (ACCC) has released a discussion paper inviting stakeholder feedback on access controls for superfast fixed-line broadband networks.


The Australian Competition and Consumer Commission (ACCC) has initiated a discussion paper as part of its inquiry into the superfast broadband access service (SBAS) access determination, which began on January 15, 2025. This inquiry aims to evaluate the regulatory framework governing wholesale access to superfast fixed-line broadband networks, excluding the National Broadband Network (NBN).

The SBAS is a regulated service that allows retailers to provide broadband services to both households and businesses connected to superfast fixed-line networks. These networks are defined as those capable of delivering download speeds of 25 Mbps or higher. The ACCC's discussion paper focuses on whether to introduce additional regulated access terms concerning the locations and characteristics of interconnection points for retailers seeking to acquire a declared SBAS.

Furthermore, the ACCC is interested in gathering opinions on other price and non-price access terms that could be included in the SBAS access determination. Access seekers have the option to request that the SBAS be supplied to them under the regulated terms outlined in an access determination, which can influence the commercial offers made by network owners and provide greater certainty regarding the terms and conditions applicable in the absence of a commercial agreement.

The ACCC is encouraging stakeholders to submit their feedback on the discussion paper by 5 pm AEDT on March 28, 2025. The paper is accessible on the ACCC's official website for review and input.
