The European Commission has launched a public consultation inviting feedback on draft revisions to the Technology Transfer Block Exemption Regulation (TTBER) and accompanying Guidelines. These revisions aim to adapt the existing rules to recent market developments and case law, ensuring that technology transfer agreements remain pro-competitive while providing legal certainty for companies.
Technology transfer agreements allow one firm to authorize another to use specific technology rights, which can promote innovation and research. The TTBER currently exempts certain agreements from anti-competitive prohibitions under Article 101(1) of the Treaty on the Functioning of the European Union (TFEU), provided they meet specific conditions.
The proposed changes include clarifications on market share thresholds, an extension of the grace period for agreements exceeding these thresholds, and modifications to the conditions for technology pools. Additionally, new guidance for Licensing Negotiation Groups (LNGs) and the inclusion of data licensing in the Guidelines reflect the growing importance of data in the digital economy.
Interested parties can submit their comments until 23 October 2025, and the Commission will consider this feedback before finalizing the revised rules, which are set to take effect by 30 April 2026.
