In the past three months, the President of the Polish competition authority has issued 20 decisions related to payment delays, with a total of 50 decisions made since the beginning of the year. The total fines imposed have exceeded 33 million PLN.
To combat payment delays, the authority has also employed soft measures, informing over 100 businesses about identified irregularities and the need to improve payment discipline.
The President is conducting administrative proceedings against companies that generate the most significant payment delays, having imposed fines on 10 companies totaling over 13 million PLN in the last three months. Notable companies fined include AmRest, Boryszew, and Brembo Poland.
In addition to fines, the authority has identified payment delays in 10 other companies but chose not to impose financial penalties due to mitigating circumstances. These companies were warned about the potential consequences of further violations under the revised regulations on preventing excessive delays in commercial transactions.
Since the amendment of the regulations in December 2022, the authority can take soft actions without initiating formal proceedings. This approach aims to change business practices by alerting companies to their payment issues and suggesting improvements to avoid future penalties.
Over 100 businesses have received notifications about potential irregularities in their payment practices this year, with some committing to review their procedures to enhance payment discipline. Companies that fail to respond or continue to create payment delays will face administrative proceedings, potentially leading to financial penalties.
