The Netherlands Authority for Consumers and Markets (ACM) has identified significant issues in the market for learning materials in secondary education, urging publishers to cease the practice of tying digital and print materials together. This recommendation aims to improve transparency and better align products with the needs of schools.

ACM's market investigation revealed that secondary schools spend around 280 million euros annually on learning materials, yet the market is not functioning effectively. Prices have increased disproportionately compared to similar products, and the offerings from publishers do not adequately meet the demands of educational institutions. The investigation highlighted that the three largest providers maintain a stable market share, leading to limited competition.

In response to these findings, ACM supports the trade association MEVW's recommendation for publishers to stop tying practices and to better cater to schools' needs. ACM has the authority to investigate publishers that hold a dominant position and continue to engage in these practices.

ACM emphasizes the role of schools in improving market conditions by developing procurement policies that focus on price, quality, and sustainability. Schools are encouraged to collaborate on procurement processes to enhance their bargaining power and secure better terms for learning materials.

Recommendations for educational publishers include offering textbooks and licenses separately and ensuring transparency in pricing. Schools are urged to refine their procurement strategies and consider collective purchasing to achieve better outcomes.
