ACCC Appeals Court Ruling Against Magnamail for Misleading Promotions

The Australian Competition and Consumer Commission (ACCC) has appealed a Federal Court decision that dismissed its case against Magnamail for allegedly making false representations in promotional materials.

The Australian Competition and Consumer Commission (ACCC) has filed an appeal against a Federal Court ruling from July 2026, which dismissed allegations that Magnamail Pty Ltd made false or misleading representations in its mail order catalogue promotions.

Between May 2022 and July 2023, Magnamail distributed promotional materials, including letters, envelopes, catalogues, and scratch cards, to a large number of consumers as part of 12 'pre-draw' prize promotions. The Federal Court ruled against the ACCC's claims regarding these promotions, leading to the current appeal.

Additionally, the court dismissed the ACCC's case against Magnamail's parent company, Direct Group Pty Ltd, but the ACCC has chosen not to appeal this aspect of the decision. The appeal hearing will be scheduled by the court at a later date.

Magnamail is a direct mail order catalogue business operating in Australia and New Zealand, selling various merchandise through catalogues. The company included promotional offers in its catalogues that required consumer purchases to participate.

In 2023, during the ACCC's investigation, Magnamail ceased its pre-draw promotions. The ACCC initially instituted proceedings against Magnamail in November 2024, alleging false or misleading statements related to these promotions, and claimed Direct Group was knowingly involved in the conduct.
