Austrian Cartel Court Fines Kienzl for Price Fixing
The Austrian competition authority has successfully imposed a fine of EUR 45,000 on Kienzl for engaging in anti-competitive practices including price fixing and market division from 2012 to 2017.

Kienzl was found to have participated in anti-competitive activities such as price fixing, market divisions, and the exchange of sensitive information with competitors from September 2012 until April 2017. This infringement affected both public and private tenders in the structural engineering sector across Austria.
Upon the application of the Austrian Federal Competition Authority (AFCA), the Cartel Court imposed a fine of EUR 45,000 on Kienzl. The decision is final, and Kienzl cooperated with the AFCA outside the leniency programme, acknowledging its infringement and assisting in clarifying the facts of the case.
The AFCA considered Kienzl's cooperation, the small size of the company, and its economic capacity when applying for a reduced fine. The ongoing investigations into the construction industry have revealed that multiple companies engaged in concerted actions to secure construction contracts, which included illegal price fixing and market divisions.
The cartel's activities involved agreements on which bidder would win contracts, the prices to be offered, and the submission of fake bids, as well as arrangements to prevent certain competitors from bidding altogether. The AFCA continues to investigate these practices, with many proceedings already concluded.
