Mediaset Fined for Misuse of Product Placement in TV Show

The Spanish competition authority has imposed a fine on Mediaset for improperly using product placement in a television program, violating audiovisual communication laws.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has sanctioned Mediaset with a fine of €212,218 for misusing product placement in the TV show 'Rediséñame' aired on October 8, 2023.

The show, which focuses on fashion design using second-hand clothing, prominently featured the brand 'Vinted' in a manner that violated Article 129.3.a) of the General Audiovisual Communication Law (LGCA). This law prohibits product placement from influencing editorial content.

Evidence of the infringement included a notable mention of 'Vinted' during an unrelated interview segment, repeated use of the brand's corporate colors, and images simulating the use of its mobile application.

The CNMC has confirmed that Mediaset's actions constituted a breach of the regulations, and the company has the right to appeal this decision in the National Court within two months of notification.
