ACM Issues Warning on Opslagplan's Misleading Telemarketing Practices

The Dutch competition authority, ACM, has raised concerns over misleading telemarketing practices by Opslagplan involving home batteries, prompting consumer complaints about high cancellation fees.

The Netherlands Authority for Consumers and Markets (ACM) has issued a warning regarding the telemarketing practices of Opslagplan, a Dutch company selling home batteries. Over recent months, ACM has received numerous reports from consumers who feel misled after engaging with Opslagplan's sales representatives.

Consumers reported that during telemarketing calls, they were asked to digitally sign what were presented as 'offers without obligation.' However, many later discovered that they had inadvertently signed binding purchase agreements for home batteries costing between 15,000 to 20,000 euros. When attempting to cancel these agreements, consumers were confronted with cancellation fees amounting to thousands of euros.

ACM has previously warned against fraudulent sales tactics in the home battery market and is currently investigating various businesses, including Opslagplan. The authority emphasizes that home batteries are not custom-made products, and consumers have the right to cancel their contracts within 14 days without incurring fees.

Opslagplan's sales practices have raised red flags, as the company is not registered with the Dutch Chamber of Commerce, and its contact information is reportedly unavailable. Consumers have indicated that they were not adequately informed about their rights to cancel their purchases during sales calls. ACM advises consumers to be cautious and to end unsolicited calls without engaging further.

In light of these issues, ACM encourages consumers to report any misleading practices and provides resources on its website for those wishing to cancel their home battery purchases or rescind contracts.
