Enefit Faces Allegations of Unnotified Concentration in Taking Over EGTO Energija Contracts

Enefit, an electricity supplier, is under scrutiny for allegedly not seeking approval from the Competition Council before acquiring EGTO energija's retail electricity supply contracts.


The Competition Council has issued a Statement of Objections (SO) to Enefit, accusing them of implementing an unnotified concentration by acquiring EGTO energija's contracts without prior approval.

Despite receiving clearance after the merger, the Competition Council initiated an investigation due to the parties submitting the notification post-implementation, breaching the Law on Competition.

Enefit admitted to the violation, acknowledging that they should have reported the concentration to the Competition Council before execution, leading to a proposed fine.

The ex-ante merger control mechanism aims to safeguard competition, emphasizing the importance of notifying and obtaining clearance from the Competition Council before implementing mergers to prevent adverse effects.

Interested parties have the opportunity to present their arguments before the Competition Council makes a final decision on the alleged infringement and potential financial penalties.
