Today, Federal Trade Commission Chairman Andrew N. Ferguson addressed 42 law firms concerning their participation in potentially unfair and anticompetitive employment practices. These firms are part of the Mansfield Certification program, which is managed by Diversity Lab, a DEI consultancy.

The Mansfield Certification requires law firms to adhere to specific DEI-based employment standards, which may involve collusion in hiring practices. The FTC's letter emphasizes that coordinating on candidate characteristics and sharing sensitive employment information can violate antitrust laws.

Chairman Ferguson highlighted that such collusion could distort competition in the legal profession, affecting hiring, pay, and promotions based on personal characteristics rather than merit. The letter serves as a reminder to law firms about the legal implications of their hiring practices.
