FTC Takes Major Action Against Amway for Deceptive Practices

The Federal Trade Commission has reached a historic settlement with Amway Corp. and its affiliates, requiring them to pay $225 million for unfair and deceptive business practices in their multilevel marketing operations.

The Federal Trade Commission (FTC) has taken significant action against Amway Corp., one of the largest multilevel marketing companies in the United States, along with its affiliates World Wide Group, L.L.C. (WWG) and Leadership Team Development Inc. (LTD). The companies will pay $225 million to resolve allegations of using unfair and deceptive tactics to recruit members into their direct selling and multilevel marketing schemes.

This settlement marks the largest monetary recovery obtained in an FTC action against a multilevel marketing company, with nearly all funds designated for consumer redress. The FTC and the state of Washington allege that Amway misled prospective Independent Business Owners (IBOs) about potential earnings and pressured them into purchasing products that were difficult to sell.

The complaint details various deceptive practices, including false earnings claims and misleading instructions for IBOs to report sales that did not occur. The FTC emphasized that such tactics create an illusion of a profitable business opportunity while primarily focusing on recruitment rather than genuine product sales.

As part of the proposed order, Amway, WWG, and LTD will be required to implement significant changes to their business practices. These include ensuring that IBOs sell at least 70% of the products they purchase, reducing compensation for recruiters whose recruits do not resell products, and instituting regular audits of sales records. Additionally, IBOs will need to undergo training on these new rules before they can recruit others.

The FTC's action underscores its commitment to protecting consumers from deceptive practices in the multilevel marketing industry, ensuring that individuals can make informed decisions about their participation in such business opportunities.
