The Autorité de la concurrence, responding to a request from the French employment platforms social relations authority (ARPE), has provided its first opinion on a collective agreement in the private-hire vehicle (PHV) sector. This agreement, signed on December 19, 2023, mandates platforms to implement a system allowing drivers to select a minimum income per kilometer traveled.
While the agreement itself does not appear to undermine free competition, the Autorité has raised concerns about its potential widespread application. The agreement was signed by a single professional platform entity, primarily Uber, and two driver trade unions. The Autorité cautions that the implementation of such a system could lead to exclusionary conduct, particularly if it enables Uber to dominate the market further.
The Autorité emphasizes the need for an in-depth impact study to assess the economic, social, and financial implications of the agreement before it is approved. This recommendation stems from the uncertainty surrounding the costs of developing the required technology and the potential for Uber to leverage its data advantage over competitors.
Furthermore, the Autorité advises the ARPE to ensure that the agreement balances social objectives with competition risks. The lack of established social benefits for drivers necessitates a thorough evaluation of the agreement's impact. The Autorité has called on the French government to provide ARPE with the necessary resources to conduct this study.
