The Federal Trade Commission (FTC) and the Department of Justice (DOJ) Antitrust Division have issued a joint letter to federal agency heads, requesting the identification of anticompetitive regulations that stifle competition, entrepreneurship, and innovation.
This initiative is part of President Trump's Executive Order aimed at reducing regulatory barriers that are deemed anticompetitive. The letter emphasizes the need for agencies to compile a list of such regulations within their rulemaking authority.
Agencies are instructed to not only identify these regulations but also to provide recommendations for their deletion, suggest specific modifications, or justify their potential anticompetitive impacts. This process is intended to streamline regulations that may be detrimental to a competitive market.
The joint letter follows a recent Request for Information from the FTC, which invited public comments on how federal regulations can negatively affect competition in the U.S. economy. The feedback from the public, along with the lists from agency heads, will be used to create a consolidated report for the Director of the Office of Management and Budget.
Ultimately, the FTC and DOJ aim to present a comprehensive list of regulations that should be rescinded or modified, along with their recommended changes, to enhance competition across various sectors.
