The Spanish competition authority, CNMC, has issued recommendations to enhance competition and transparency in the new regulation on deforestation-free products, emphasizing the need to prevent sensitive information exchange among operators.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has released a report on the draft law implementing the EU Regulation 2023/1115 concerning the marketing of deforestation-free products. This initiative aims to align national legislation with European standards to enhance traceability and sustainability in the supply chain of products linked to deforestation.

The regulation covers various products, including palm oil, soy, coffee, cocoa, beef, wood, and rubber. Economic operators will be required to verify the origin of these products, ensuring they do not come from deforested areas and maintaining updated information for market access.

While the CNMC supports the proposed reforms for improving product traceability and sustainability, it has identified several areas for improvement regarding competition and regulatory principles. Key recommendations include preventing the exchange of sensitive information among competitors and clarifying certification activities to avoid conflicts of interest.

The CNMC can issue advisory reports at the request of legislative chambers, government departments, and other organizations, ensuring that competition principles are upheld in the implementation of this new regulation.
