Polish Competition Authority Imposes Fines for Non-Compliance

The Polish competition authority has issued fines totaling 1.1 million PLN for companies failing to cooperate during investigations into anti-competitive practices.


The Polish competition authority, known as UOKiK, has recently enforced penalties totaling 1.1 million PLN against companies that did not comply with requests for information during investigations into anti-competitive agreements. These fines highlight the authority's commitment to combating collusion that harms consumers and the economy.

UOKiK's ability to conduct unannounced searches is crucial in uncovering evidence of illegal practices, as colluding companies often communicate through private channels like emails and messaging apps. During these searches, companies are legally required to cooperate fully with UOKiK officials, providing access to documents and data storage devices.

In one case involving KIA Poland and its dealers, a dealer named Landcar failed to provide requested information, resulting in a fine of 700,000 PLN. The maximum penalty for non-compliance can reach up to 3% of a company's annual turnover. This decision is not yet final and can be appealed in court.

Another case involved the company M.A.S., which did not provide requested business phones and emails during a search related to suspected bid rigging. UOKiK imposed fines of 350,000 PLN on M.A.S. and 50,000 PLN on its CEO, Dariusz Niesiobęcki. Similar to the previous case, these decisions are also subject to appeal.

UOKiK reminds companies involved in anti-competitive practices that they can avoid severe financial penalties through a leniency program. Additionally, the authority encourages whistleblowers to report information anonymously through a dedicated online platform.
