The Polish competition authority has taken action against two companies, Med Professional and Medical Factory, for engaging in deceptive practices during promotional events across the country. Consumers were lured to these events under false pretenses, such as free health checks or the chance to win prizes, only to be pressured into purchasing overpriced products.
Both companies, managed by the same individual, used manipulative tactics to create a sense of urgency and exclusivity among consumers. Telemarketers falsely claimed affiliations with reputable organizations to enhance credibility, while attendees were misled about the nature of the events, which were actually sales presentations disguised as giveaways.
During these events, consumers were often told they had won prizes, but the catch was that they had to purchase products at inflated prices to claim them. Complaints from consumers revealed that many felt rushed and confused, leading to agreements that they later regretted, often involving significant financial commitments.
The competition authority's president, Tomasz Chróstny, emphasized that businesses must provide clear and truthful information about the purpose of their invitations. The companies were fined over 700,000 PLN each, and the individual managing them received an additional penalty of 500,000 PLN for allowing these violations to occur.
Furthermore, the authority mandated that the companies cease their misleading practices immediately and inform all affected consumers about their rights, including the right to cancel purchases and receive refunds. The authority continues to monitor such promotional activities closely and will take further legal action against any dishonest operators.
