ACCC Proposes Changes to NBN Regulation for Enhanced Consumer Protection

The Australian Competition and Consumer Commission (ACCC) has released a draft determination aimed at improving service quality and consumer protections for the National Broadband Network (NBN) starting July 2026.

The Australian Competition and Consumer Commission (ACCC) has unveiled a draft determination that seeks to enhance service quality and consumer protections for the National Broadband Network (NBN) effective from July 1, 2026. This initiative is part of the ACCC's ongoing efforts to ensure that NBN Co operates efficiently while safeguarding consumer interests.

ACCC Chair Gina Cass-Gottlieb emphasized the importance of the NBN as essential infrastructure for Australian households and businesses. The draft determination outlines the ACCC's preliminary views on NBN Co's expenditure, revenue requirements, and service standards, following extensive consultations with stakeholders.

The proposed changes include enhancements to benchmark service standards, aimed at improving consumer experiences, particularly for those using copper, fixed wireless, and HFC services. The ACCC aims to reduce wait times for connections and fault resolutions, ensure adequate network speeds, and provide timely notifications for rescheduled technician appointments.

Additionally, the ACCC proposes that the entry-level NBN product will shift to a 25/10 Mbps speed tier by mid-2027, reflecting the growing demand for higher upload speeds. This change is intended to make faster upload capacity a standard expectation for all users.

In terms of financial regulation, the ACCC's draft determination suggests a lower annual building block revenue requirement (ABBRR) for NBN Co, arguing that some of the company's proposed expenditures were not prudent or efficient. The ACCC's preliminary estimates indicate a significant reduction in forecast capital expenditure compared to NBN Co's proposal.

The ACCC is inviting feedback on the draft determination until April 28, 2026, which will inform the final decision expected in June 2026. The regulatory framework governing NBN Co is established under the Special Access Undertaking (SAU), which has been in place since 2013 and is set to operate until 2040.
