The Portuguese Competition Authority (AdC) has launched an investigation into a business association for allegedly setting minimum prices in the tourism sector, resulting in a formal Statement of Objections. This investigation began in June 2024 and uncovered evidence that the association had been engaging in price-fixing practices since at least 2020.
The AdC's findings revealed that the business association recommended specific prices in fee schedules and established minimum percentage increases for prices charged by its member companies and other service providers. Such practices are considered serious infringements of competition law, as they undermine consumer welfare and the competitiveness of businesses.
Upon issuing the Statement of Objections, the AdC has provided the association with a reasonable timeframe to respond and defend itself against the allegations. Following the conclusion of the investigation and the exercise of the rights of defense, the AdC will make a final decision regarding the case.
The AdC emphasizes that business associations must not engage in price-setting practices, as this behavior violates competition rules and harms consumers. To promote compliance, the AdC has published a Guide for Business Associations to inform them about prohibited conduct and the benefits of maintaining competition. This investigation is part of the AdC's broader strategy to combat anti-competitive practices and engage with the business community across Portugal.
