Austrian Authority Seeks €175,000 Fine Against Whistleblower in Waste Management Cartel

06.03.2025 | Austrian competition authority

The Austrian competition authority has requested a €175,000 fine against whistleblower Huber for her role in a waste management cartel, despite her cooperation in the investigation.

The Austrian competition authority, known as BWB, has filed a request for a €175,000 fine against Huber, a whistleblower who cooperated under the leniency program to clarify the details of a waste management cartel. Huber's cooperation and her lesser role in the cartel were significant factors in determining the fine amount.

Huber participated in illegal activities including price-fixing, market division, and the exchange of sensitive competitive information related to public and private tenders for waste collection in Carinthia from at least 2003 until March 2021. Her violations were part of a nationwide cartel that operated from at least July 2002 to March 2021.

The BWB considered several factors when calculating the fine, including Huber's cooperation, her minor role in the cartel, and her lower economic capacity compared to other involved companies. The fine framework for smaller companies, which is lower due to their comparatively smaller revenue, also played a crucial role in the final decision.
