Dutch Energy Suppliers Improve Transparency on Early-Termination Fees After ACM Investigation

Following an investigation by the Dutch competition authority, five energy suppliers have committed to better inform customers about early-termination fees, while one supplier remains under scrutiny.

The Netherlands Authority for Consumers and Markets (ACM) has conducted an investigation into six energy suppliers regarding their compliance with rules on early-termination fees. This investigation was prompted by consumer complaints submitted through ACM’s consumer information portal, ACM ConsuWijzer.

During the investigation, it was found that the six suppliers did not consistently adhere to the regulations concerning early-termination fees. Five of these suppliers—Greenchoice, Essent, Clean Energy, Innova Energie, and Mega Energie—cooperated fully with ACM and have committed to improving their communication with customers regarding these fees. They have also refunded approximately 230,000 euros in wrongly collected fees.

ACM's investigation revealed that many suppliers failed to provide timely and accurate information about early-termination fees when customers decided to cancel their energy contracts. The rules, which were updated in the summer of 2023, require suppliers to inform customers immediately about any fees associated with early termination and to provide an estimate of those fees.

Manon Leijten, a member of ACM's board, emphasized the importance of clear communication from energy suppliers to help consumers make informed decisions about switching suppliers. ACM has issued guidance to all energy suppliers to reinforce compliance with the rules and will continue to monitor the situation, particularly with the one remaining supplier under investigation.
