CNMC Proposes Flexibility in Broadband Replicability Analysis for Telefónica

The CNMC is updating the methodology to assess if Telefónica's fiber offers can be replicated by other operators, aiming to enhance competition in the market.


The CNMC is conducting a public consultation to revise the methodology for analyzing the replicability of Telefónica's fiber offers by other operators, aligning with the EU's Gigabit Recommendation.

The methodology evaluates if Telefónica's wholesale fiber prices enable competition in areas with limited competition, with Telefónica setting these prices based on passing the replicability test.

Proposed changes include assessing replicability on a portfolio basis, removing time limitations on promotions, simplifying cost calculations, and reducing information obligations on Telefónica.

The consultation also updates parameters for the Net Present Value calculation, confirming that NEBA local and NEBA fiber prices meet replicability conditions.
