Qwant S.A.S., a player in the online search services sector, filed a complaint against Microsoft Corporation, alleging abuse of dominance and economic dependence. Qwant claimed that Microsoft engaged in exclusivity and tied selling practices that hindered its ability to develop an AI model and discriminated against it in accessing search-related online advertising.
However, the Autorité de la concurrence found that Qwant did not provide adequate evidence to support its claims. The authority concluded that Microsoft was not in a dominant position in the relevant market and that the conditions for establishing economic dependence were not met.
The investigation revealed that while Qwant relies on Microsoft technology, it also has its own search capabilities and has launched a joint syndication offering with Ecosia. The authority noted that Google's dominance in the search-related advertising market further complicates claims of Microsoft's market power.
Ultimately, the Autorité rejected Qwant's complaint and the request for interim measures due to a lack of sufficient evidence to substantiate the allegations made against Microsoft.
