Findings from the investigation indicated that there is no dominant market position held by any gas station in Lungau. Market shares in the retail sector were mostly below the 30% threshold that indicates dominance. Additionally, no single fuel supplier controlled more than 30% of the total supply in the region, and there were numerous alternative options available in the procurement market.
Despite gas stations in Lungau charging higher prices per liter compared to those in neighboring areas, the investigation found no evidence of higher profitability among these stations. The higher prices were attributed to significantly lower sales volumes in Lungau, which were 20-35% lower than in comparison districts, leading to higher fixed costs that needed to be covered.
The BWB noted that a price competition exists that benefits consumers, but the high fixed costs remain a challenge. The investigation also revealed that a relatively inexpensive diesel station had failed to report its prices to the E-Control price transparency database. Following this, the BWB observed a noticeable decrease in average diesel prices in Lungau, alongside a significant increase in actual price reports.
Furthermore, it was discovered that at least three other gas station operators in Lungau had not complied with their reporting obligations under the price transparency law. This issue was reported to the local administrative authority for further action. The BWB emphasized the importance of transparency measures for consumers, stating that visibility of competitive prices can lead to informed purchasing decisions.
As of March 25, 2025, gas stations in Lungau were found to be selling diesel at prices lower than those in neighboring districts, according to the E-Control price transparency database. The BWB continues to recommend the use of the E-Control fuel price calculator for consumers.
In conclusion, the investigation confirmed the absence of market dominance and ruled out any abuse of a dominant position. There were no indications of cartel agreements, and the higher prices at Lungau gas stations were explained by the need to cover higher fixed costs due to lower sales volumes. The BWB will continue to monitor compliance with reporting obligations to the price transparency database.
