ACCC Seeks Feedback on Joint Tender for Rail Profiling Services

The Australian Competition and Consumer Commission has proposed to authorize a joint tender process for rail profiling services by Queensland Rail and Aurizon Network, while revoking an existing interim authorization.

On February 12, 2025, the Australian Competition and Consumer Commission (ACCC) released a draft determination that proposes to grant authorization to Queensland Rail Limited and Aurizon Network Pty Ltd. This authorization would allow the two companies to jointly conduct a tender process for rail profiling services.

In conjunction with this proposal, the ACCC has revoked the existing interim authorization and has granted a new interim authorization that covers a broader scope of conduct. This change aims to facilitate better collaboration between the two rail service providers.

The ACCC's proposal includes a significant duration of 15 years for the authorization, indicating a long-term commitment to the joint tender process. The commission is currently inviting submissions from the public regarding the draft determination, with a deadline set for March 6, 2025.
