Polish Competition Authority Fines Play for Unlawful Penalties on Late Payments

The Polish competition authority has imposed a fine on Play for unfairly penalizing customers with higher bills due to late payments, deeming the practice illegal.

The Polish competition authority, UOKiK, has fined P4, the operator of Play, over 108 million PLN for imposing unfair penalties on customers who delay payments. The company’s discount system, which offers a monthly rebate for timely payments, results in higher bills for customers who miss deadlines.

According to UOKiK President Tomasz Chróstny, the mechanism of losing discounts acts as an unlawful contractual penalty for late payments. The law allows for interest on overdue payments but prohibits additional sanctions for late transfers.

Play has been using this discount structure for over six years, where a missed payment leads to the loss of a 5 PLN discount, increasing the subsequent bill. This practice has resulted in consumers facing double penalties: statutory interest and higher monthly fees.

UOKiK has mandated that P4 cease this practice and refund customers who lost discounts due to late payments since September 30, 2019. The company must inform affected customers about their rights to refunds and the process to claim them.

This decision is part of UOKiK's broader scrutiny of discount practices in the telecommunications sector, with ongoing investigations into other companies like T-Mobile and Orange.
