The Comisión Nacional de los Mercados y la Competencia (CNMC) has resolved a complaint filed by Iryo concerning the denial of access to its rolling stock at the heavy maintenance workshops of Renfe Mantenimiento. The CNMC found that Renfe Mantenimiento unjustifiably denied access just weeks before Iryo's planned operations.

Renfe Mantenimiento had negotiated with Iryo for over 18 months regarding access conditions but withdrew its offer without sufficient justification. This withdrawal posed a risk of immobilizing Iryo's trains, potentially impacting their ability to meet capacity commitments with infrastructure managers.

The CNMC has mandated that Renfe Mantenimiento allow Iryo's trains access to the La Sagra workshop for specific operations, while also allowing the parties to reach an alternative agreement. However, the CNMC did not support Iryo's request for access to perform all operations related to the “R2” intervention, as this was not included in Renfe's original offer.
