The German competition authority's investigation into the fuel wholesale market has been temporarily halted by a decision from the Düsseldorf Higher Regional Court.

The Bundeskartellamt's investigation, initiated in March 2025, aimed to assess competitive conditions in the fuel wholesale market and the role of price information services. The court's decision comes after complaints from Argus Media and S&P Global regarding information requests made by the authority.

Andreas Mundt, President of the Bundeskartellamt, expressed surprise at the court's ruling and stated that they have appealed to the Federal Court. The investigation is crucial for understanding the competitive dynamics from drilling to retail, particularly concerning the influence of price information services on market behavior.

The investigation followed a sector inquiry completed in February 2025, which indicated significant competitive risks associated with the price information services used in the fuel wholesale market. These services provide detailed pricing information that could dampen competition and potentially lead to price manipulation.

This case marks the first application of a new competition tool introduced in 2023, allowing the Bundeskartellamt to take action against significant and ongoing competitive disturbances without needing to prove specific legal violations by companies.

The Düsseldorf court has raised doubts about the authority's ability to issue binding information requests under this new provision, suggesting a lack of sufficient legal basis. The court also highlighted concerns regarding press freedom, indicating that the requirement for price information services to disclose their sources may not be proportionate.

As a result of the court's ruling, the Bundeskartellamt will not continue the investigation under this provision until the Federal Court clarifies the legal foundations. Meanwhile, teams formed to enforce related regulations will focus on other ongoing investigations.
