French Competition Authority Issues Guidance on Carbon Footprint Data Sharing Platform
The French competition authority has released informal guidance regarding a new platform aimed at collecting and sharing suppliers' carbon footprint data in the retail sector, emphasizing compliance with competition laws.

The Autorité de la concurrence has published informal guidance concerning the creation of a platform for collecting and sharing data on suppliers’ carbon footprints in the French retail sector. This guidance follows a request from two professional retail organizations involved in the Low Emission Sustainable Sourcing (LESS) project.
The General Rapporteur deemed the request admissible and noted that the project could be analyzed as an agreement that creates a collective database without raising significant competition concerns. Key factors included the absence of sensitive information exchanges between competitors and the platform's open, voluntary, and non-exclusive nature.
However, the General Rapporteur highlighted several important considerations for the project’s implementation. These include ensuring easy access for all suppliers, maintaining the quality of information, and avoiding any coordination between competitors regarding decarbonization strategies. The guidance also cautioned against the potential risks of discussing and publicizing suppliers' decarbonization commitments, which could be seen as exchanges of sensitive information.
The LESS project aims to centralize data on retailers’ indirect emissions, allowing suppliers to share their CO2 emissions data and reduction commitments. OpenClimat will manage the platform, ensuring the accuracy of the information provided. Retailers will benefit from a dashboard that consolidates their suppliers' data, enhancing transparency and efficiency in emissions reporting.
