The Autorité de la concurrence has published informal guidance on the ReUse project, which seeks to establish a standardized deposit-return scheme for food packaging in France. This guidance follows a request from Citeo, an eco-organization, for clarity on the project's compatibility with competition law.
While the General Rapporteur acknowledged the request, he noted that the information provided was insufficient for a thorough examination of the project's compliance with competition rules. However, he offered an analysis framework to assist stakeholders in developing the project responsibly.
Key points highlighted include the need for eco-organizations, particularly Citeo, to avoid favoring their own initiatives over competitors and to refrain from exchanging sensitive commercial information. The selection of service providers must be objective and transparent, with contracts structured to promote competition.
The General Rapporteur emphasized the importance of safeguarding competition throughout the project, advising against the exchange of commercially sensitive cost data and suggesting the appointment of a third party to oversee such information. The guidance aims to help stakeholders navigate the complexities of competition law while pursuing sustainable initiatives.
