The European Competition Network (ECN) has introduced guidelines to address abusive conduct by dominant companies, aiming to enhance legal certainty and promote coherent enforcement of Article 102 of the TFEU.

The guidelines cover various behaviors that distort effective competition to the detriment of public interest, other market participants, and consumers.

The ECN emphasizes the importance of proving the ability of certain behaviors to cause exclusionary effects, highlighting the need for a proportional burden of proof concerning the likelihood of harm caused by such conduct.
