Lisbon Court of Appeal Upholds Fine on EDP and SONAE for Non-Competition Agreement
The Lisbon Court of Appeal upheld a fine on EDP and Sonae for a non-competition agreement, deeming the process urgent due to the impending expiration of the statute of limitations.

The Lisbon Court of Appeal (TRL) affirmed the decision to fine EDP and Sonae for a non-competition agreement in 2017, with fines totaling 34.4 million euros. The agreement between EDP and Sonae restricted competition in the national electricity market, leading to violations of competition rules. The Court also confirmed that the infringement was intentional. The CJEU supported the decision, stating that such non-competition clauses can distort competition. The process will proceed during judicial vacations to prevent the expiration of the statute of limitations. The AdC had initially sanctioned EDP - Energias de Portugal, S.A., EDP Comercial - Comercialização de Energia, S.A., Sonae Investimentos, SGPS, S.A., Sonae MC - Modelo Continente SGPS, S.A., and Modelo Continente Hipermercados, S.A. for the anti-competitive agreement.
