Clorox Fined $8.25 Million for Misleading Ocean Plastic Claims

Clorox Australia has been ordered to pay $8.25 million for misleading consumers about its GLAD products being made from recycled ocean plastic, following a court ruling by the Australian Competition and Consumer Commission (ACCC).


The Federal Court has imposed a penalty of $8.25 million on Clorox Australia Pty Ltd for making false claims regarding its GLAD kitchen and garbage bags. The company misrepresented that these products contained 50% recycled 'ocean plastic', which was found to be untrue.

Between June 2021 and July 2023, Clorox marketed its GLAD products with packaging that suggested they were made from recycled plastic waste collected from the ocean. However, the reality was that the products were made from plastic waste sourced from communities in Indonesia lacking formal waste management systems, as well as non-recycled plastic materials.

ACCC Chair Gina Cass-Gottlieb emphasized the importance of accurate environmental claims, stating that misleading representations undermine consumer trust and disadvantage competitors who provide truthful information. The court noted that the packaging's imagery and wording created a false impression of environmental friendliness.

In addition to the financial penalty, Clorox is required to implement a compliance program for Australian Consumer Law, publish a corrective notice on its website, and cover part of the ACCC's legal costs. The company cooperated with the ACCC during the investigation and has since discontinued the misleading products.

The ACCC has also released guidance for businesses on making environmental claims, highlighting the need for clarity and accuracy to protect consumers and promote fair competition.
